Before major electric transmission facilities can be constructed in New York, they must first receive approval from the state’s Public Service Commission. Article VII of the New York Public Service Law lays out the process utilities must follow to receive this critical certification.
The New York State Public Service Commission — part of the state’s Department of Public Service —oversees the electric, gas, water and telecommunication industries, including the enforcement of the state’s Public Service Law.
Article VII is the section of the Public Service Law that requires a full review of the need for and environmental impact of the siting, design, construction and operation of major transmission facilities in the state. It lays out a rigorous review and permitting process for the construction and operation of new high-voltage (100-kV or more) electric transmission lines and other major new utility transmission facilities that meet the law’s design capacity and length parameters.
